WAYPOINT AERIAL SERVICES — TERMS OF SERVICE

1. Acceptance of Terms 

By accessing this website or engaging Waypoint Aerial Services ("Company") for aerial media, inspection, mapping, 3D modeling, or data acquisition services, you agree to be bound by these Terms of Service.

2. Scope of Services & Legal Disclaimers 

Waypoint Aerial Services provides technology solutions for aerial data acquisition and high-resolution media.

• Non-Engineering & Non-Surveying Notice: 

Waypoint Aerial Services is not a state-licensed professional engineering or land surveying firm, and its employees are not state-licensed professional engineers or land surveyors.

• Informational Purpose Only: 

All deliverables—including 8K aerial imagery, thermal datasets, 2D orthomosaic maps, and 3D digital twins—are provided solely for general informational and visual management purposes. They do not substitute for certified land surveys, official engineering assessments, or legal boundary determinations.

3. Payment Terms & Billing

• Final Deliverable Release: The balance is due upon project completion prior to the delivery of un-watermarked, high-resolution final assets.

• Late Payments: Invoices unpaid past 30 calendar days from the invoice date accrue a late charge of 1.5% per month (18% per annum) or the maximum rate permitted by law.

4. Weather, Flight Safety & Cancellation Rules

Pilot in Command (PIC) Authority:

 Under FAA Part 107 regulations, the Remote Pilot in Command holds absolute authority regarding flight safety. Flights may be paused, rescheduled, or aborted at the PIC's sole discretion due to high winds, precipitation, low visibility, severe weather, or sudden airspace restrictions.

Weather Rescheduling:

 Operations postponed due to weather or airspace safety holds will be rescheduled for the next available flight window at no additional cost to the Client. All deposits transfer directly to the rescheduled date.

Client-Initiated Cancellations:

• • More than 48 hours notice: Full deposit refund or 100% credit applied toward a rescheduled flight.

  • 24 to 48 hours notice: Deposit is non-refundable but fully transferable to a rescheduled date within 60 days.

  • Less than 24 hours notice: Subject to a 25% mobilization fee to cover logistical preparation and site scheduling lock-out.

5. Site Access & Property Authorizations 

The Client guarantees that they possess all necessary property rights, landowner permissions, and occupant clearances required for drone operations over the target site. The Client agrees to indemnify the Company against claims arising from unauthorized site access representations.

6. Intellectual Property & Licensing

• Ownership: Waypoint Aerial Services retains full original copyright and intellectual property rights to all raw footage, photographs, and spatial datasets captured.

• Client License: Upon full payment of all fees, the Client receives a perpetual, non-exclusive, worldwide license to use, display, and publish the final deliverables for marketing, internal management, and operational purposes.

7. Limitation of Liability 

The Company's total liability for any claim arising out of or related to these services shall not exceed the total fees paid by the Client for the specific project.
